In Congress


Continuing Resolution

Because Congress still has resolved budget debates and passed appropriations bills, it will need to pass another continuing resolution by March 27. The bill passed by the House of Representatives (H.R. 933) holds non-defense spending at the levels approved in Fiscal Year 2012.

One consequence of this is, at least for the time being, the increased spending on surface transportation programs included in MAP-21 will not be enacted. Senate leaders indicated that they might add transportation spending increases in that chamber.

Senate Questions Interior Secretary Nominee

The Senate Energy and Natural Resources Committee posed questions to Sally Jewell, President Barack Obama’s nominee for Secretary of Interior. As you might expect, questions focused on energy development on federal lands and environmental protection related to such projects. Of particular concern was hydraulic fracturing (fracking) for natural gas production in western states and oil drilling in the Pacific Ocean and Alaska.

USGS Evapotranspiration Maps Available

U.S. Geological Survey (USGS) scientists have mapped long-term average evapotranspiration rates across the continental United States.  It will be a useful tool for water managers and planners because of the huge role evapotranspiration plays in water availability.

Why are evapotranspiration rates important to know? The amount of water available for people and ecosystems is the amount of annual precipitation (snow or rain) minus the amount of annual evapotranspiration.  Evapotranspiration is the amount of water lost to the atmosphere from the ground surface.  Much of this loss is the result of the transpiration of water by plants.

Evapotranspiration has been difficult to measure accurately on a regional or continental scale.  To produce these maps, USGS scientists examined satellite imagery for climate and land-cover data and streamflow data for more than 800 watersheds.  This information allowed them to generate a mathematical equation that can be used to estimate long-term evapotranspiration in the continental United States.  

One interesting finding illustrated in the maps is that in certain regions, such as the High Plains and the Central Valley of California, evapotranspiration exceeds the amount of precipitation because water is imported from other regions.  The map also shows that the Pacific Northwest has many areas with low evapotranspiration to precipitation rates because of the area’s very high rainfall and low-to-moderate temperatures.  In contrast, counties in the arid Southwest have evapotranspiration rates that usually exceed 80 percent of precipitation.

New Congress Gets to Work (Sort of), Other Federal Government News


A Look Back, 112 Congress Passed Transportation Bills

For all of its heel dragging, the 112th Congress managed to pass some infrastructure-relate bills.  On the transportation front, it passed the Moving Ahead for Progress in the 21st Century Act (MAP-21).  MAP-21 was primarily and extension of highway programs through the end of September 2014 with authorization for small funding increases.

EPA Administrator Stepping Down

Environmental Protection Agency (EPA) Administrator Lisa Jackson announced that she plans to leave the post early this year (read her statement→).  Deputy Administrator Bob Perciasepe is expected to lead the agency, possibly indefinitely.

House Transportation & Infrastructure Chair Promises Active Committee

Rep. Bill Shuster (PA), newly appointed chairman of the House T&I committee, committed himself to passing important legislation and assuring the committee is active in oversight.  Legislation priorities include reauthorization of the Water Resources Development Act and surface transportation programs.  Oversight goals include implementation of reforms enacted in MAP-21.

Missouri Senator Calls for Decision of Levee Project

Sen. Claire McCaskill (MO) requested that the EPA and U.S. Fish and Wildlife Service resolve their issues related to levee and drainage projects in southeast Missouri, particularly including the St. Johns Bayou levee.  These Corps of Engineer projects were halted because of concerns over fish and wildlife habitat.*

Barge Traffic Threatened on Missouri & Mississippi Rivers


Levels on the Missouri and Mississippi Rivers continue to drop.  One of the consequences of low river levels is the dangers it poses to navigation, especially to barge traffic.  Low levels have exposed rocks and sand bars on both rivers.

Barges on these rivers transport a lot of goods, especially commodities.  This is a significant part of the economy of states along these rivers, especially those on the lower Mississippi River.  For instance, in Missouri the Missouri Economic Research and Information Center estimated that nearly $3 billion in Missouri commodities, mostly agricultural products, are shipped on water.  Water freight generates an estimated $388 million annually in gross state product (GSP) in Missouri.

To some degree, flow in these rivers is controlled by dams operated by the U.S. Army Corp of Engineers.  Officials and businesses along the Mississippi River have asked the Corp to release more water.  The Corp agreed, and on December 15 began releasing water Carlyle Lake (a little more than 50 miles east of St. Louis) on the Kaskaskia River, which flows into the Mississippi River a few a few miles downstream of Ste. Genevieve, Missouri.

The Corp has tried to tame these rivers for more than a century, managing them for navigation, flood control, and other purposes.  It may not get any easier.  Many are predicting that climate change will result in more droughts and flooding along with more frequent extreme high and low levels of water in the rivers.

A couple of days ago, IW was quick to draw knives on a proposal to pump water from the Missouri River to the Colorado River through a pipeline that would run from Leavenworth, Kansas, to Denver, Colorado.  Recently Interior Secretary Ken Salazar admitted that this was not a practicable plan and that western states need to seek solutions elsewhere.

Will the Missouri River be the Next Colorado River?


The Bureau of Reclamation and the seven states that are part of the Colorado River Compact (Arizona, California, Colorado, Nevada, New Mexico, Utah, and Wyoming) announced a proposal for a pipeline to carry water from the Missouri River to the western states.  The very preliminary proposal suggests a pipeline beginning near Leavenworth, Kansas, to Denver, Colorado.  It would take 30 year to build at a price of more than $11 billion, not to mention the energy bills for pumping the water and the constant operational and maintenance costs.

Infrastructure Watch does not abound with opinions as much as do some other blogs, but since we are based in Missouri, you would be right to guess we have an opinion on this.  The states and communities along the Missouri River have enough water resources problems of their own.  They’ve already been battling over use of the river, and the aquifers that have made the Midwest a great producer of grain are already showing signs of overuse.  If we’re teetering on the edge of a water crisis, we don’t have the resources to bail out the West.  Because the lower Mississippi River gets a significant amount of flow from the Missouri River, those states may have a few things to say about it, too.

We don’t mind seeing the west grow.  We just don’t want to be the Owens Valley to their Los Angeles.  If the Bureau of Reclamation has the vision to imagine a spectacular pipeline, maybe they should envision the problems it will cause and its eventual failure.  We need to get real about the water we have, when and where we have it, wherever we are.

Book Review: Blue Revolution by Cynthia Barnett

America has a problem.  We’re a thirsty nation.  Actually, it’s more like we’re addicted to water, abusing it.  We subsidize its use on a grand scale in industries that use it inefficiently, even wastefully, and in locations where it is naturally hard to come by.  We allocate it based on facts that are no longer true, and were doubtful or changing even as we made our policies.  In our sometimes blind enthusiasm, we overreached and now we are mire in unintended consequences.  To top it off, we rarely change our ways until a crisis is already upon us.

Cynthia Barnett describes these problems in her book Blue Revolution.  She also looks around the country and the world for solutions.  Her essential solution is a water ethic.


Atnone time, people were intimately connected to water.  Farmers watched for rain.  Children fetched pails of it from the stream or worked a pump handle.  Communities were built around watermills where people brought in grain or carried away flour. 

Of course, water is no less essential to modern life.  We depend on it for drinking, cleaning, sanitation and green lawns.  It is essential or the energy that light and cools our homes and powers our computers.  The abundance of food in our groceries stores is partly a testament to the abundance of water used to irrigate fields that don’t get enough rainfall for the crops we grow.

What is different is the way we view water.  For most of us it is cheap, nearly free in comparison to other utilities and services we use in our homes.   We can get as much as we want whenever we want by opening a valve.  Water is something we hold back with dams, divert with canals, and pump through pipes.  It bends to our will—except when it doesn’t.

Our water policies and technologies have often had unintended consequences.  We turned deserts into productive fields, but much of the water is lost to evaporation.  We moved water great distances to supply cities, but it encouraged profligacy that threatens those distant, expensive supplies.  Dams that were engineering marvels may soon stand at the ends of empty lakes.

Sure, changes in technology and policy are needed to stop, and hopefully reverse, these problems.  Barnett doesn’t stop there.  Our approach to water arises from the way we value it, think about it, and relate to it.  Our present state came from valuing water little, thinking about it little unless it was our job, and relating to it little except for those who intensely depended on a highly subsidized supply.

The water ethic Barnett proposes would value water, both in the sense of personal appreciation and economic cost and opportunity.  It would seek the best use of the water we have, especially what is locally available.  It creates opportunities for people to contact water and understand where it comes from and how it is affected by use.  It is something that spreads organically from person to person, neighborhood to neighborhood, business to business, and city to city.

It is an ethic that is within reach, too.  Barnett describes how places that have long had extreme relationships with extreme water environments, like the Netherlands, Singapore and Australia, have changed their relationship with water.  These are not just policy shifts, they are cultural changes.  Even in the United States, there are places where a new water ethic is taking hold and people understand how important and fragile water is.

Russell E. Train, Conservationist & Environmental Policy Pioneer, Died


Russell E. Train died yesterday, Sept. 17, 2012.  Train was one of the primary proponents of the National Environmental Policy Act of 1969.  Richard Nixon, whom he previously served as Under Secretary of Interior, appointed him as the first chair of the Council on Environmental Quality; he served in that post from 1969 to 1977.  Gerald Ford appointed him Administrator of the Environmental Protection Agency.

Train became a leader in the World Wildlife Fund in 1978.  Train had previously worked in conservation organizations.  He became president of the Conservation Foundation in 1965 and in 1961 he founded the African Wildlife Leadership Foundation.  Under his leadership, the World Wildlife Fund expanded its role to preserving habitat as well as advocating for wildlife.

Infrastructure Watch (or at least a certain contributor) appreciates that Train was a collector of books, particularly those related to wildlife and conservation.  The Smithsonian Institution acquired his collection of Africana in 2004.

Congress Keeps Rolling

Congress seems stymied in coming us with a budget that doesn’t bankrupt the government, i.e. the one thing it really needs to do. It’s up to a lot of other stuff, though. Here is a taste.

Sen. Jeff Bingaman (NM) has introduced the Energy and Water Integration Act of 2011 (S. 1343). The bill would

- Commission the National Academy of Sciences to study water use in the energy sector.
- Direct the Secretary of Energy to
-- Study alternative technologies for water efficiency in energy generation.
-- Develop roadmap for the future of energy-water research.
-- Conduct a comprehensive water and energy savings study.
- Direct the Secretary of the Interior to study energy efficiency in Reclamation projects.
- Fund ground water desalination research.
- Provide grants for water and energy conservation demonstration projects.
- Provided technical assistance related to energy and water efficiency to rural drinking water and wastewater utilities.

Missouri, Manitoba Force Bureau of Reclamation to Take “Hard Look” at Project

Missouri and the Canadian province of Manitoba sued to prevent the transfer of water from Lake Sakakawea of the Missouri River to Minot, ND. They claim that this interbasin transfer would introduce alien species to the waterways effected by the project.

This is the second time Judge Rosemary Collyer (U.S. District Court for the District of Columbia) has ordered the Bureau of Reclamation to take a “hard look” at the project and its environmental effects. Collyer found that the Bureau’s environmental review was too narrow, considering only the anticipated change in lake levels as a result of the transfer.

Portions of the pipeline that is part of the Northwest Area Water Supply Project have already been constructed. The project ran into trouble in 2002 when Manitoba first filed suit.

Book Review: Water by Marq de Villiers

de Villiers, Marq. Water: The Fate of Our Most Precious Resource. 1999. Boston: Houghton Mifflin, 2000.

Marq de Villiers serves as a guide on a tour of water problems, conflicts and occasional solutions around the world. Though he is not an alarmist, his book seems to indicate that the problems have so far greatly outpaced the solutions.

There are several aspects of water problems and conflicts that de Villiers considers: natural, technological and political. In each area, he provides specific examples of water in or nearing crisis.

The natural distribution of fresh water in the world is uneven. That may be the fundamental aspect of water problems: even where it’s seemingly abundant, it doesn’t occur where and when people want it to make use of it. In parts of the world, this is a dire situation.

The technological solutions people have applied to correct this distribution have resulted in some amazing works of engineering since early in human history. It has also had many unintended consequences. Irrigation that made marginal land productive has made some of that land useless, even desert, through increased salinity. Dams, drainage and transfers have created ill effects in regional climates. Water mining, pollution and other human activity are also threatening the quantity and quality of water even in developed nations. There is hope in the technological area in that much of this harm may be reversible and the human ingenuity that created these technologies might also create sustainable solutions to our water needs.

Political considerations are very important to water issues, particularly when considering the possibility of conflict, even outright war, because of water scarcity. The Middle East and North Africa come to mind as hot spots where water is a critical issue; de Villiers enlightens both the current situation and history of these regions. Though mistrust runs deep between the nations in this region, even seemingly friendly ones, there is hope for solutions to their water problems. North America has its water problems to, and the problems on the Colorado River are surprisingly similar to those on the Nile. The differences in water availability in the United States, Mexico and Canada also makes for interesting relations between these close and usually friendly neighbors. China may present the largest political problems related to water and it’s food production and population that threatens to push it into crisis.



The book closes with four general strategies for dealing with the world’s water problems. First, get more water by either bringing it in from elsewhere or making it (i.e. desalination). Next is conservation and pricing to reduce demand and encourage using water in the most valuable ways. Third is population control; de Villiers seems relieved that world populations have been growing more slowly without major intervention. Finally, you can steal water from others. Since 40 percent people worldwide live in watersheds that cross national boundaries, it becomes a complicated matter of who has what right to the water and this is a potential source of water conflict, though not insurmountable.

National Water Research & Development Initiative Reported Out of House Committee

The National Water Research and Development Initiative Act of 2009 (H.R. 1145) is proceeding through the House of Representatives, where it was recently reported out of the Committee on Science and Technology. The bill would

-Establish an interagency committee on water supply.

-Establish a national water initiative coordination office with a full-time staff to support the work of the interagency committee.

-Require development of a plan that will prioritize federal water research and related funding.

-Establishes specific outcomes for federal agencies on the interagency committee including, among several others, a national water census.

-Authorize the Department of Energy to study the development of impaired waters for energy production.

Bill Would Limit Greenhouse Gas Considerations in Endangered Species Decisions

Sen. John Barrasso (Wyo.) has introduced a bill (S. 724) modifying the Endangered Species Act. The bill would prohibit the Secretary of Interior from considering global climate change as a natural or manmade factor affection decisions about whether species are endangered or threatened until the Administrator of the Environmental Protection Agency confirms that all major emitters of greenhouse gases have signed an international agreement to limit carbon emissions. Major emitters of greenhouse gases includes China, India and the United States.

Nominations for Federal Environmental and Infrastructure Posts Announced

President Barack Obama recently announced his nominees for several posts at agencies with responsibilities for infrastructure or the environment.

DEPARTMENT OF ENERGYScott Blake Harris for General Counsel. Harris is Managing Partner of Harris, Wiltshire & Grannis LLP, a Washington, D.C. law firm with nationally known telecommunications, litigation, and appellate practices. From 1994 to 1996, Mr. Harris served as the first chief of the International Bureau at the Federal Communications Commission. Before joining the Commission, he was Chief Counsel for Export Administration at the U.S. Department of Commerce. Prior to government service, Mr. Harris was a partner at the law firm of Williams & Connolly. Mr. Harris is a magna cum laude graduate of both Brown University and Harvard Law School.

Kristina M. Johnson Under Secretary of Energy. Johnson is currently the provost and senior vice president for academic affairs of Johns Hopkins University. Previously, Johnson served as the Dean of Duke University's Pratt School of Engineering from 1999-2007 where she helped to set up interdisciplinary efforts in photonics, bioengineering and biologically inspired materials, and energy and the environment. Before that she was on the faculty of the University of Colorado, Boulder from 1985-1999 where she led an NSF Engineering Research Center and involved engineers, mathematicians, physicists, chemists and psychologists in working to make computers faster and better connected. Johnson is an electrical engineer with more than 129 US and foreign patents or patents pending. These inventions include pioneering work on liquid crystal on silicon (LCOS) microdisplays and their integration into demonstration and commercial systems such as heads-up automotive displays (HUD); pattern recognition systems for cancer prescreening, object tracking and document processing; HDTV and 3D projection displays; and 3D holographic memories. She has co-founded several companies and is the author of 142 peer reviewed publications. Johnson has received several awards including the John Fritz Medal, widely considered the highest award in the engineering profession. She earned degrees from Stanford University including a Ph.D. in 1984 and both a bachelor's and a master's degree in electrical engineering in 1981.


DEPARTMENT OF INTERIORMichael L. Connor for Director, Bureau of Reclamation. Connor has more than 15 years of experience in the public sector including serving as the Counsel to the U.S. Senate and Natural Resources Committee since May 2001. As Counsel, he has negotiated and managed legislation related to water reclamation, Indian lands and energy issues. Connor also directed the Water & Power Subcommittee which has legislative oversight of the Bureau of Reclamation and the US Geological Survey. From 1993 to 2001, Connor served at the Department of the Interior as deputy director and then director of the Secretary's Indian Water Rights Office. Connor received his J.D. from the University of Colorado School of Law, and is admitted to the bars of Colorado and New Mexico. He has a B.S. in Chemical Engineering from New Mexico State University.

DEPARTMENT OF TRANSPORTATIONJoseph C. Szabo for Administrator, Federal Railroad Administration. Szabo is currently the Illinois State Legislative Director for the United Transportation Union. As State Director Joe has provided vision and direction to rail safety and regulatory issues and worked with business and civic leaders in the advancement of freight and passenger rail service. Joe also serves on the Federal Railroad Administration's Rail Safety Advisory Committee participating in the development of federal regulations on rail safety. Prior to this Joe served as the Mayor of the Village of Riverdale where he managed over 100 employees and budget of $9 Million serving 15,000 residents. Joe was elected Mayor after serving ten years as a Village Trustee

ENVIRONMENTAL PROTECTION AGENCYMichelle J. DePass for Assistant Administrator for International Affairs. DePass is currently a program officer at the Ford Foundation where she manages the foundation's initiative on Environmental Justice and Healthy Communities. Her work concentrates on the environmental and social justice intersections in the United States and supporting transnational linkages that support environmental justice policies and practices. She taught federal environmental law and policy at the City University of New York, developed and administered a bi-state workforce development training program for disadvantaged youth on superfund waste sites, and served as executive director of the New York City Environmental Justice Alliance. In this position, she assisted communities and community organizations in their negotiations with government agencies, implemented advocacy campaigns and co-organized the Northeast Environmental Justice Network. Subsequently, she served as Assistant to the City Manager of San Jose, California, advising on environmental policy matters, and served as an Environmental Compliance Manager for the City of San Jose. After completing a term with the Center for Constitutional Rights in New York as a William Kunstler Racial Justice Fellow, Michelle joined the New Jersey Department of Environmental Protection where she was Senior Policy Advisor to the Commissioner. In this position, she developed a framework for an Environmental Justice Order that required the use of public health data to identify communities for priority compliance, enforcement, remediation, siting and permitting action. She received a B.A. in Political Science from Tufts University, a law degree from Fordham University School of Law, and a Master of Public Administration degree from Baruch College School of Public Affairs.

Cynthia J. Giles for Assistant Administrator for Enforcement and Compliance Assurance. Giles is Vice President and Director of Conservation Law Foundation's Rhode Island Advocacy Center, where she has focused on state and regional advocacy to combat climate change. From 2001 to 2005, Cynthia served as head of the Bureau of Resource Protection at the Massachusetts Department of Environmental Protection. Giles worked for the U.S. Environmental Protection Agency in a variety of capacities from 1991 to 1997. From 1995-1997, she was Enforcement Director for Region 3 and developed a "results-targeted" approach to enforcement, which she has since published in a paper written for OECA. Her responsibilities included overseeing enforcement of federal laws regulating toxics and protecting air, drinking water and surface water. She also chaired a regional ozone compliance initiative, developing strategies for reducing smog-causing emissions from stationary sources. Prior to joining EPA, Giles was an Assistant United States Attorney, where she prosecuted violations of federal environmental laws. She holds a BA from Cornell University, as well as a JD from the University of California at Berkeley and an MPA from the Harvard University Kennedy School of Government. She is admitted to the bar in the State of Rhode Island, U.S. District Court for the District of Rhode Island and State of Pennsylvania.

Gina McCarthy for Assistant Administrator for Air and Radiation. McCarthy is currently the Commissioner of the Connecticut Department of Environmental Protection (DEP). McCarthy came to the Connecticut DEP from the Commonwealth of Massachusetts, where she worked on environmental issues at the state and local level for 25 years in a variety of high-ranking positions. Just prior to joining the Connecticut DEP, she served as the Deputy Secretary of Operations for the Massachusetts Office of Commonwealth Development, a "Super Secretariat" that coordinates policies and programs of that state's environmental, transportation, energy and housing agencies. In 1990, Governor Dukakis appointed McCarthy as Chair of the Council to oversee the review of a proposed hazardous waste incinerator in the Boston area.

House Passes Stimulus Bill

The House of Representatives passed the American Recover and Reinvestment Act of 2009 (H.R. 1) on January 28. The bill would put additional funds into several infrastructure related programs. Federal Facilities and LandMany provisions of the bill provide funding for construction of improvements on federal facilities and land under the management of several departments.

Rural Water and Waste
The U.S. Department of Agriculture’s water and waste program would receive an additional $1.5 billion.

State Revolving Fund
An additional $6 billion would go to the state revolving fund (SRF) for wastewater and $2 billion for drinking water. The Environmental Protection Agency would have to make the money available to states within 30 days. The states would have to commit half the money within one year and the rest within two years. This is much more realistic than the 120 day requirement in earlier proposals. The bill would also require at least half of the stimulus package funds for the SRF to go to municipalities. The potential for funding investor-owned systems is also affected by law of the states that operate the SRF program, so it is uncertain how much this requirement will effect the availability of funds for investor-owned systems.

Water Resources and Flood Control
The Natural Resources Conservation Service would receive $400 million for watershed and flood control improvements and operations. The Corp of Engineers would receive $2 billion for construction. The Department of Interior would receive $500 million for water and related resources.

Other Infrastructure and Environment Bills
The economic stimulus package isn’t the only thing working its way through Congress. Some additional bill are:
-Sustainable Water Infrastructure Investment Act of 2009 (HR537)--Removes the volume cap for private activity bonds for water and sewage facilities.
-Water Use Efficiency and Conservation Research Act (HR631)--Funds activities related to water use efficiency and conservation.

Congress to Consider Recovery Bill

Congress will be considering the American Recovery and Reinvestment Bill of 2009 over the next few weeks. The bill covers federal spending and programs in many areas, including infrastructure.

Some of the spending proposed under the bill include
-Airport improvement, $3 billion-Broadband internet in rural area, $6 billion
-Brownfields, $100 million
-Clean water, flood control and environmental restoration, $19 billion
-Clean Water State Revolving Fund, $6 billion
-Community Development Block Grants, $1 billion
-Drinking Water State Revolving Fund, $2 billion
-Energy transmission, distribution and production, $32 billion
-Highway construction, $30 billion
-Renewable energy loans, $8 billion
-Rural Water & Waste Disposal, $1.5 billion-Transit and rail, $10 billion
